1. Definitions

“F-Cubed (Form Field Filler),” “we,” “us,” or “our” refers to F-Cubed (Form Field Filler) and its operators, affiliates, and assigns.

“User,” “you,” or “your” refers to any individual, entity, or organization that accesses or uses the Service.

“Service” refers to the F-Cubed (Form Field Filler) platform, including but not limited to form identification, form field mapping, PDF generation, form filling, and any associated tools, APIs, or interfaces.

“Output” refers to any filled forms, generated PDFs, field mappings, or other content produced by the Service.

“User Data” refers to any data, documents, images, form content, or personal information that you provide to or through the Service.

2. No Reliance — AI-Generated Output Disclaimer

THE SERVICE IS PROVIDED AS AN ASSISTIVE TOOL ONLY.

F-Cubed (Form Field Filler) uses artificial intelligence, machine learning models, and computer vision to identify form fields, interpret form requirements, and populate form data. While we strive for accuracy, the Service is not infallible and may produce errors.

You expressly acknowledge and agree that:

1. All Output generated by the Service is provided on an “as-is” basis and may contain errors, omissions, inaccuracies, or misplacements of data within form fields.
2. You are solely responsible for reviewing, verifying, and validating all Output before submitting, filing, or relying upon any filled form for any purpose whatsoever.
3. The Service does not constitute legal, tax, financial, medical, immigration, or professional advice of any kind. F-Cubed (Form Field Filler) is a technology tool, not a licensed professional advisor.
4. You should consult with a qualified professional (attorney, CPA, immigration counsel, etc.) before relying on any Output for official filings, regulatory submissions, or legal matters.
5. F-Cubed (Form Field Filler) shall not be liable for any consequences arising from your reliance on Output without independent verification, including but not limited to rejected filings, penalties, fines, missed deadlines, or adverse legal outcomes.

3. Third-Party AI Services and Data Processing

The Service utilizes third-party artificial intelligence APIs and models (collectively, “Third-Party AI Services”) to perform certain functions, including but not limited to form field detection, document analysis, text recognition, and form completion. By using the Service, you acknowledge and agree to the following:

1. Data Transmission to Third Parties. Your User Data, including form content, images, and associated information, may be transmitted to Third-Party AI Service providers for processing. These providers operate under their own terms of service and privacy policies.
2. Potential Use of Data for Model Training. Third-Party AI Service providers may, under their respective terms and policies, use data submitted through their APIs to improve, train, or fine-tune their AI models. F-Cubed (Form Field Filler) does not control and cannot guarantee how Third-Party AI Service providers handle data once transmitted. We encourage you to review the terms of service and privacy policies of applicable providers.
3. No Guarantee of Confidentiality with Third Parties. While F-Cubed (Form Field Filler) takes reasonable measures to protect your data, we cannot guarantee that Third-Party AI Service providers will treat your data as confidential or that your data will not be used for purposes beyond the immediate processing request.
4. Sensitive Information Warning. You should exercise caution before submitting forms containing highly sensitive personal information (such as Social Security numbers, financial account numbers, medical records, or immigration documents) through the Service. You assume all risk associated with transmitting sensitive data through the Service and its Third-Party AI Services.
5. Changes in Third-Party Policies. Third-Party AI Service providers may change their terms, privacy practices, or data handling policies at any time. F-Cubed (Form Field Filler) will make reasonable efforts to stay informed of material changes but is not responsible for monitoring or communicating every change made by third-party providers.

4. User Responsibilities

You agree to the following when using the Service:

1. You will review all Output carefully before use, submission, or filing.
2. You will not use the Service for any unlawful purpose, including but not limited to fraud, forgery, identity theft, or the submission of falsified documents.
3. You will ensure that all data you provide to the Service is accurate, complete, and lawfully obtained.
4. You will not use the Service to fill forms on behalf of third parties without their knowledge and express consent.
5. You will comply with all applicable federal, state, local, and international laws and regulations when using the Service and its Output.
6. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

5. Intellectual Property

All form mappings, field descriptions, fill instructions, annotation methodologies, proprietary models, software, algorithms, and associated intellectual property embedded in the Service are the exclusive property of F-Cubed (Form Field Filler). You may not reverse engineer, decompile, disassemble, or attempt to derive the source code, mapping libraries, or training data of the Service.

You retain ownership of your User Data. By using the Service, you grant F-Cubed (Form Field Filler) a limited, non-exclusive, worldwide license to process your User Data solely for the purpose of providing and improving the Service.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, F-CUBED (FILE FIELD FILLER), ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

IN NO EVENT SHALL F-CUBED (FILE FIELD FILLER)'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO F-CUBED (FILE FIELD FILLER) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100.00), WHICHEVER IS GREATER.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, F-CUBED (FILE FIELD FILLER) DOES NOT WARRANT THAT:

1. The Service will meet your specific requirements or expectations.
2. The Service will be uninterrupted, timely, secure, or error-free.
3. The Output will be accurate, complete, or suitable for any particular purpose, including official filings or regulatory submissions.
4. Any errors in the Service will be corrected.
5. Form field positions, data placements, or fill values will be correct for any given form.

8. Indemnification

You agree to indemnify, defend, and hold harmless F-Cubed (Form Field Filler), its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your reliance on any Output without independent verification; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) your infringement of any third-party rights.

9. Data Privacy and Security

F-Cubed (Form Field Filler) collects and processes User Data in accordance with our Privacy Policy, which is incorporated into these Terms by reference. We implement commercially reasonable security measures to protect User Data within our systems. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.

You acknowledge that forms processed through the Service may contain personally identifiable information (PII), protected health information (PHI), financial data, or other sensitive information. You are responsible for ensuring that your use of the Service complies with all applicable data protection laws, including but not limited to HIPAA, GDPR, CCPA, and any other applicable regulations.

10. Service Availability and Modifications

F-Cubed (Form Field Filler) reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may update these Terms from time to time. Continued use of the Service after any such changes constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify users of material changes.

11. Acceptable Use Policy

You may not use the Service to:

1. Generate, submit, or facilitate fraudulent, forged, or falsified documents.
2. Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
3. Violate any applicable law, regulation, or government order.
4. Transmit malware, viruses, or any code designed to interfere with the Service.
5. Attempt to gain unauthorized access to the Service, other accounts, or any computer systems or networks connected to the Service.
6. Scrape, harvest, or extract form mappings, fill instructions, or proprietary data from the Service.
7. Resell, sublicense, or redistribute the Service or its Output without prior written consent from F-Cubed (Form Field Filler).

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. Sections 2, 3, 5, 6, 7, 8, 9, and 13 shall survive termination.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Chicago, Illinois. You agree to waive any right to a jury trial or to participate in a class action.

14. Miscellaneous

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and F-Cubed (Form Field Filler) regarding the Service and supersede all prior agreements and understandings.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Waiver. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.

Assignment. You may not assign or transfer these Terms or your rights hereunder without F-Cubed (Form Field Filler)'s prior written consent. F-Cubed (Form Field Filler) may assign these Terms without restriction.

Force Majeure. F-Cubed (Form Field Filler) shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, or failures of Third-Party AI Service providers.
